More recently, online casino players have been informed that the European nation of Denmark has been given total permission to establish a market for online gambling by the European Commission in a ruling that, operators have stressed, points the way to how other European countries should regulate the activity.

Just this past month of May, the Danish Gambling Authority (DGA) revised their stance in regard to online foreign operator and added the following to a specific clause: “In special cases, the Danish Gambling Authority may allow part of the licensee’s gambling system to be located in a country that is not covered by a bilateral supervision agreement in accordance with subsection 2 if supervision by the Danish Gambling Authority of this part of the gambling system can be conducted in a satisfactory manner.”
However, more recently the commission investigated Denmark’s plans to introduce lower taxes for online gambling than for land-based casinos after several issues presented by some existing gambling operators that the proposals amounted to state aid. Denmark’s Gaming Duties Act proposes that operators offering online casino and gaming slot machines be subject to a 20 per cent tax on gross gaming revenues – the amount they retain after paying out winnings – compared with the 75 per cent duty imposed on some land-based casinos. The commission said while the lower rate did count as state aid, it was compatible with European Union rules “because the positive effects of the liberalization of the market outweigh the distortions of competition brought about by the measure”.
